Victim/Complainant Rights

Victims of sexual assault, dating/domestic violence and stalking have the right to be treated with respect.

Additional victim's rights include:

  • The right of both accuser and accused to have the same opportunity to be accompanied by an advisor of their choosing during any meeting or proceeding, such as an investigation meeting or a conduct hearing.
  • The right not to be discouraged from reporting by college officials.
  • The right to be informed of the outcome and sanction of any disciplinary hearing without condition.
  • The right to be informed of options to notify proper law enforcement authorities, including on-campus and local police, and the option to be assisted by campus authorities in notifying such authorities, if the student so chooses. This also includes the right not to report an incident, if this is the victim's desire.
  • The right to be notified of and access available counseling, health, mental health, victims advocacy, legal assistance, visa and immigration assistance, student financial aid, or other services, both on campus and in the community, regardless of the victim's decision to report or not.
  • To be informed of options for changing academic, living, transportation and working situations, if requested by the victim and reasonably available.
  • The right not to be asked and/or have irrelevant prior sexual history admitted in a campus hearing.
  • The right not to have incidents of non-consensual sexual intercourse mediated (as opposed to adjudicated).
  • The right to request a University-issued no-contact order against another student who has engaged in or threatens to engage in harm, stalking, threatening, harassing or other improper behavior that presents a danger to the welfare of the victim.
  • The right to obtain an emergency protective order pursuant to a court proceeding.
  • The right to have complaints responded to quickly and with sensitivity by college officials.
  • The right to report the incident anonymously.
